On March 11, Engage Mountain Maryland hosted a webinar with attorney Harris Eisenstein, who outlined what landowners could face if the Mid-Atlantic Resiliency Link (MARL) transmission line is approved by the Public Service Commission (PSC). NextEra Energy is the developer that submitted an application to the PSC known as a CPCN, or Certificate of Public Convenience and Necessity.
The PSC will review the application to determine whether NextEra Energy has met all criteria to construct the 107-mile transmission line connecting power generation facilities in southwestern Pennsylvania to data centers in northern Virginia. The line will cut through parts of West Virginia and Maryland, and, should the CPCN be approved, NextEra Energy will gain the authority to exercise eminent domain to acquire land along the transmission line's path.
If approved, the CPCN will be made public, allowing registered individuals, organizations, and businesses to submit comments or opposition. To register and be heard, select the link below. Energy bills that passed through the 2025 Maryland General Assembly have established an aggressive position on infrastructure development, claiming to help provide a more reliable power grid and deliver customer (rate-payer) savings. Engage Mountain Maryland is following this issue.
Sadly, with development comes destruction and the use of private property through eminent domain. This process can be terribly upsetting to landowners who treasure their untouched surroundings. The Mid-Atlantic Resiliency Link, or MARL, as it is commonly called, is the transmission line charted to clear a 200-yard-wide path through Garrett and Allegany Counties, making way for new overhead transmission lines.
